El Tribunal Superior de Justicia de Londres desestima el procedimiento de Induyco para mantener la indemnización emitida por el tribunal arbitral internacional el 21 de octubre de 2009

En una decisión con fecha 1 de julio de 2010, el Tribunal Superior de Justicia de Londres desestimó el procedimiento de Induyco para mantener la indemnización emitida el 21 de octubre de 2009 e indemnizó a Lectra por los costes y honorarios incurridos para defender el procedimiento.

En su indemnización (cf. comunicado de prensa con fecha 28 de octubre de ) el tribunal arbitral constituido según lo estipulado en las normas de la Cámara Internacional de Comercio, indemnizó a Lectra con 25,6 millones de euros por daños e intereses hasta el 30 de junio de 2010 (asegurado hasta 15,1 millones de euros mediante garantías bancarias entregadas a Lectra por Induyco de acuerdo con el contrato de compra de acciones).

Induyco opposed to the payment of the award and commenced proceedings in Spain to challenge Lectra's demand under the bank guarantees, and in England to challenge the validity of the award. (cf. press release dated November 27, 2009).

The High Court's decision of July 1, 2010 puts an end to the action brought in England to set aside the award and strengthens Lectra's position that the suit brought in Spain-for which hearings are now expected in the second half of 2010-to suspend the execution of the bank guarantees is entirely groundless.

Lectra is reinforced in its commitment to enforce its rights and recovery of the amounts due to it under the award.

At this stage, the company has not recorded the amounts awarded by the arbitral tribunal in its accounts.
